Federal Court enters default against Dark Angel end-user Karapet Menemshyan, awards $10,000 in statutory penalties and issues a permanent injunction

On February 6, 2012 the United States District Court for the Central District of California granted DISH Network and NagraStar’s motion for default against Karapet Menemshyan.  Menemshyan was sued by DISH Network and NagraStar for federal claims arising out of her subscription to the Dark Angel services. The Court’s order includes a permanent injunction against Menemshyan as well as an award of $10,000 in statutory damages (the maximum damages per violation) under the Electronics Communication Privacy Act (“ECPA”) and an additional $1,200 in fees/costs. DISH Network and NagraStar continue to investigate and take action against those responsible for trying to circumvent the companies’ security system in order to gain unauthorized access to DISH Network programming.

On December 22, 2011 the United States District Court for the District of New Jersey granted DISH Network and NagraStar’s motion for default against Alecia Thomas.  Thomas was sued by DISH Network and NagraStar for federal claims arising out of her subscription to the Dark Angel services. The Court’s order includes a permanent injunction against Thomas as well as an award of $10,000 in statutory damages (the maximum damages per violation) under the Electronics Communication Privacy Act (“ECPA”). DISH Network and NagraStar continue to investigate and take action against those responsible for trying to circumvent the companies’ security system in order to gain unauthorized access to DISH Network programming.

On December 19, 2011 the United States District Court for the District of New Jersey granted DISH Network and NagraStar’s motion for default against Sammy Goncalves.  Goncalves was sued by DISH Network and NagraStar for federal claims arising out of his subscription to the Dark Angel services. The Court’s order includes a permanent injunction against Goncalves as well as an award of $10,000 in statutory damages (the maximum damages per violation) under the Electronics Communication Privacy Act (“ECPA”). DISH Network and NagraStar continue to investigate and take action against those responsible for trying to circumvent the companies’ security system in order to gain unauthorized access to DISH Network programming.

On January 5, 2012 the United States District Court for the Eastern District of North Carolina granted DISH Network and NagraStar’s motion for default against Marian Dubar.  Dubar was sued by DISH Network and NagraStar for federal claims arising out of her subscription to the Dark Angel services. The Court’s order includes a permanent injunction against Dubar as well as an award of $10,000 in statutory damages (the maximum damages per violation) under the Electronics Communication Privacy Act (“ECPA”). DISH Network and NagraStar continue to investigate and take action against those responsible for trying to circumvent the companies’ security system in order to gain unauthorized access to DISH Networkprogramming.


Texas Federal Court Grants Summary Judgment Against Dark Angel End-User Elvis Perry, Awards Over $20,000 to NagraStar/DISH and Enters Permanent Injunction

Thursday 2012-01-05

On December 16, 2011 the United States District Court for the Northern District of Texas granted summary judgment against Dark Angel end-user Elvis Perry. The Court ruled that Perry’s subscription to the Dark Angel IKS Service constituted a violation of the Electronics Communications Privacy Act (“ECPA”) and awarded NagraStar and DISH Network $10,000 in statutory damages plus $11,471 in attorneys’ fees and $2,118.26 in costs. The Court also entered a permanent injunction against Perry prohibiting him from future violations. DISH Network and NagraStar continue to investigate and take action against those responsible for trying to circumvent the companies’ security system in order to gain unauthorized access to DISH Network programming.

It seems to me that any person plugging in a device to their STB and then connecting to a server would sooner or later get tracked back to the device in the STB due to the IP address assigned to the device.  It's definitely cheaper to just get a subscription, go OTA or FTA.

I am not suprised Echo is going after end users. Directv did the same a few years back.

currently using a openbox S9 Hd and S10 Hd with a 10 ft c band dish and a 39' ku motorized dish. true fta rocks... as does LFTA and Hypermegasat!

I wonder if Bell ever had anything happen to them ,after they were caught stealing our local channels and charging for them.I seen this about a year ago on our news .

I wonder if Bell ever had anything happen to them ,after they were caught stealing our local channels and charging for them.I seen this about a year ago on our news .

Haven't seen them going after the end users in Canada yet, but there is talk. I know DTV and Nagrastar are aggressively doing it in Europe, so it is only a matter of time. They did arrest a guy in Winnipeg this week and confiscated his equipment, but I'm not sure if he was selling receivers or if he was an IKS hub.

RCMP bust satellite-TV-stealing operation
Inspectors raid two Winnipeg locations

Hundreds of receivers used to steal satellite TV signals have been seized in one of the largest telecommunications busts in years.

RCMP and Industry Canada inspectors raided two Winnipeg locations, a business on St. Mary’s Road and a residence on Lodge Avenue, Wednesday at 10 a.m.

They seized $26,000 in equipment, including nine computers and 144 satellite television receivers.

“The receivers were modified in a fashion that would enable them to receive a pay TV signal without being a paid subscriber,” said RCMP spokesman Cpl. Miles Hiebert.

WIRELESS SECURITY CAMERAS SEIZED

RCMP also seized uncertified wireless security cameras which were being offered for sale at the store. The cameras operate on frequencies reserved for aeronautical navigation, which means they pose a security risk for Canada, RCMP says.

A 29-year-old Winnipeg man was arrested at the home. He’ll face charges under the Criminal Code and the Radiocommunications Act.

More arrests are coming, but Hiebert couldn’t comment on whether those targeted would be fellow scammers or people who had been using the stolen TV signals and equipment.

“Our investigation is continuing and could go in any number of directions,” Hiebert said. “I can confirm this is a significant arrest and seizure for the RCMP federal enforcement section. I am told it has been a number of years since we have made a seizure of this type in the province.”

RCMP remind the public that stealing TV services is illegal, as is the sale of equipment modified to intercept television signals illegally.
